Opinion No. 46-4932

July 27, 1946

BY: C. C. McCULLOH, Attorney General

TO: Dorothy W. Miller, Secretary State Board of Cosmetologists 209 First National Bank Bldg. Albuquerque, New Mexico

{*256} This will acknowledge receipt of your letter of July 24, 1946, in which you request the opinion of this office on whether laws regulating hours of employment in New Mexico are applicable to students enrolled in a school of cosmetology.

There are several different laws in New Mexico which regulate the hours of employment for both male and female employees. However, it is my opinion that none of these laws apply to hours of attendance of students enrolled in a school of cosmetology since a student, as such, is not an employee (See 14 Words and Phrases 365).

The hours of attendance of such students would be fixed by rules and regulations promulgated by the school.

Asst. Atty. General
