Opinion No. 46-4910

June 17, 1946

BY: C. C. McCULLOH, Attorney General

TO: Dorothy W. Miller, Secretary State Board of Cosmetologists 209 First National Bank Bldg. Albuquerque, New Mexico

{*238} We are in receipt of your letter of June 14, 1946 in which you state that a local school of cosmetology occupies the same premises as a millinery shop with only a partition separating the two, and with no separate outside entrance. You ask our opinion as to whether these premises meet the requirements of the statute.

Section 51-2010 of the 1941 Compilation provides in part as follows:

"(a) Schools must be located so as to be entirely separate and have no connection with beauty shops or any other place of business. A separate entrance for the use of the school must be provided."

In view of this statute, it appears that the premises upon which the school is operated are improperly situated, first, because there is no separate entrance and, second, because the business is connected physically with another business.

By ROBERT W. WARD,

Asst. Atty. General

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
