14-4505. Careless driving; essential elements.

            For you to find the defendant guilty of careless driving [as charged in Count ________]1, the state must prove to your satisfaction beyond a reasonable doubt each of the following elements of the crime:

            1.         The defendant operated a motor vehicle2 on a highway3;

            2.         The defendant operated the motor vehicle in a careless, inattentive or imprudent manner without due regard for the width, grade, curves, corners, traffic, weather, road conditions and all other attendant circumstances;

            3.         This happened in New Mexico, on or about the ________ day of ____________, ________.
