OPINION
This matter coming on for consideration by the Court upon Motion of Respondent to dismiss the proceedings herein, and the Court having considered said motion and being sufficiently advised;
NOW, THEREFORE, IT IS ORDERED that the Motion of Respondent is hereby granted, and the above proceedings are hereby dismissed;
IT IS FURTHER ORDERED that the writ of certiorari heretofore issued by this Court on March 28, 1991 is hereby quashed as having been improvidently issued;
IT IS FURTHER ORDERED that the Record in Cause No. 12172 is hereby returned to the Clerk of the Court of Appeals.
