WHEREAS, this matter came on for consideration by the Court upon petition for writ of certiorari, and the Court having considered said petition and being sufficiently advised;

NOW, THEREFORE, IT IS ORDERED that the petition hereby is GRANTED on the issue of whether dismissal for want of notice was proper; and

IT IS FURTHER ORDERED that no additional briefing or oral argument shall be ordered by this Court and the cause shall be submitted to the Court on the December 1995 calendar.
