OPINION

This matter coming on for consideration by the Court upon Suggestion of Death and Motion to Abate Proceedings from Inception, and the Court having considered said suggestion and motion and being sufficiently advised;

NOW, THEREFORE, IT IS ORDERED that the Suggestion of Death is hereby acknowledged;

IT IS FURTHER ORDERED that the Motion to Abate Proceedings from Inception is hereby granted, and the Order granting the Petition for writ of certiorari is vacated and set aside, and the writ of certiorari heretofore issued is hereby quashed.

IT IS FURTHER ORDERED that the Record in Cause No. 9947 is hereby returned to the Court of Appeals.
