OPINION

WHEREAS, this matter came on for consideration by the Court upon a petition for writ of certiorari, and the Court having considered said petition and being sufficiently advised, granted the petition and entered its writ of certiorari to the New Mexico Court of Appeals on February 24, 1993; and

WHEREAS, the cause having been submitted to the Court upon oral argument by Amme M. Hogan, Assistant Appellate Defender, for petitioner and Joel K. Jacobsen, Assistant Attorney General, for respondent, and, upon further consideration, the Court having determined to quash the writ of certiorari.

NOW, THEREFORE, IT IS ORDERED that writ of certiorari issued on February 24, 1993, is hereby QUASHED, and the record in cause numbered 13,277 hereby is returned to the New Mexico Court of Appeals.
