OPINION

WHEREAS, this matter came on for consideration by the Court upon a petition for writ of certiorari and motion for rehearing, and the Court having considered said petition and motion and being sufficiently advised, granted the petition and entered a writ of certiorari to the New Mexico Court of Appeals on March 22, 1993; and,

WHEREAS, upon supplemental briefs and oral argument presented for petitioner by his attorney, Amme M. Hogan, Assistant Appellate Defender, and for respondent by its attorney, William McEuen, Assistant Attorney General, the Court has decided to quash the writ of certiorari to the New Mexico Court of Appeals; and

NOW, THEREFORE, IT IS ORDERED that the writ of certiorari issued on March 22, 1993, hereby is QUASHED and the record in Court of Appeals cause numbered 13,329 hereby is returned to the New Mexico Court of Appeals.
