1 IN THE SUPREME COURT OF THE STATE OF NEW MEXICO 2 May 26, 2017 3 NO. 22,245 4 DENNIS BYBEE, 5 Plaintiff-Appellant, 6 v. 7 CITY OF ALBUQUERQUE, 8 Defendant-Appellee. 9 ORDER 10 WHEREAS, on May 24, 1995, the Supreme Court issued an opinion on 11 certification from the New Mexico Court of Appeals in Bybee v. City of 12 Albuquerque, No. 22,245; 13 WHEREAS, the opinion in Bybee was subsequently published in the New 14 Mexico Reports at 120 N.M. 17 and in the Pacific Reporter at 896 P.2d 1164; 15 WHEREAS, a vendor-neutral, official citation was assigned to the opinion 16 in 2012, but the official citation, 1995-NMCA-061, erroneously classified the 17 opinion using the form of citation for an opinion of the New Mexico Court of 18 Appeals rather than for an opinion of the Supreme Court of New Mexico; and 1
1 WHEREAS, to correct the erroneously issued official citation for the 2 opinion issued in Bybee v. City of Albuquerque, the official citation should be 3 changed to correctly classify the opinion as one issued by the Supreme Court of 4 New Mexico; 5 NOW, THEREFORE, IT IS ORDERED that the official citation for the 6 opinion issued by the Supreme Court on May 24, 1995, in Bybee v. City of 7 Albuquerque shall be changed from 1995-NMCA-061 to 1995-NMSC-081; and 8 IT IS FURTHER ORDERED that the New Mexico Compilation 9 Commission shall publish a copy of this order in place of the opinion previously 10 published under the official citation of 1995-NMCA-061 and shall recompile the 11 opinion in this matter within the New Mexico Appellate Reports under the 12 official citation of 1995-NMSC-081. 13 DONE at Santa Fe, New Mexico, this 26th day of May, 2017. 14 ( S E A L ) 15 ____________________________________ 16 Joey D.
