Opinion No. 23-3700

May 3, 1923

BY: JOHN W. ARMSTRONG, Assistant Attorney General

TO: Requested by: Mrs. Grace B. Melaven, State Game & Fish Warden, Santa Fe, New Mexico.

Fifty Trout May be Taken in One Day Provided They do Not Exceed Ten Pounds in Weight.

OPINION

{*50} Your query, in effect, is: What is the limit of trout which may be taken by one person in any day?

Said Section 6 provides that the right given by this Act to take fish is limited to fifty trout, or ten pounds of trout and one trout, no trout less than six inches in length.

{*51} According to our view, one trout, regardless of weight, in addition to the ten pounds, may be taken. This is the limit, however, which may be taken regardless of any consideration of number. Of course, fifty trout may be so taken provided they do not exceed the 10-lb. limit.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
